How does a judicial claim of rights on behalf of an heir or purchaser in court work - is it because we believe the claim is likely true, or is it because we borrow the legitimacy of the replacement claim in order to support the litigant's own claim, or is it because the purchaser/heir isn't the actual litigant? Also: פתח פיך לאלם, and the issue of arguing in the alternative in court. a court allowed/obligated to intervene on behalf of a litigant, and why isn't this an inappropriate violation of judicial neutrality?
