Description

Damage caused to and from a chavis=kad (jug) placed in reshus harabim by its owner. The mishna deals with a number of different and related issues. 1) The stationary mazik of bor and its relationship to obstacles/ stumbling blocks placed in reshus harabim, 2) Obstacles/stumbling blocks placed in reshus harabim either intentionally or through one's negligence, 3) Obstacles/stumbling blocks in reshus harabim owned by someone who was not responsible in any way (due to his his negligence) for creating the stumbling block in reshus harabim.. 4) Whether a person has a responsibility to look on the ground in front of him while he is walking (l'hisbonein b'drachim). 5) Whether a person's stumbling is a form of negligence (nitkal poshe'ah).
