Description

This shiur will begin our analysis of the central theme of the second Perek of Bava Batra, i.e., HaRchakot Nitzkei Scheinim, the laws that require a property owner to be careful about what he does in his property if it will damage his next door neighbor. We will analyze the case of digging a ditch for the purpose of collecting water, and explore the possibilities as to what the precise nature of the damage is, and how far does the "digger" need to distance himself from the field of his neighbor and why. The opinion of Rebby Yose will once again be analyzed in the light of the views of the Rosh & the Ritzbah who claim that Rebby Yose accepts the view of the Chachamim in a number of situations.
