This shiur will focus on the controversy between the Rosh & the opinion quoted in the Meiri as to whether the Halacha of the Chachamim obligating the Mazik to pay damages even though he has implemented his required Harchaka applies to the Mishna of Tanur (oven) exclusively or to all the cases throughout the Perek when Harchaka is required. We will examine the thought process of the Ramban in his essay Dina DiGarmi regarding the case of the tree whose roots damage his neighbor's Bor.
