Dividing the Mishna into three parts, one - "karov" combined with a "shiur" of 50 amot; two - "karov" on its own, independent of "shiur", this is defined as "kirva delo muchach" and can only be considered in the absence of "rov"; three - the law of "mamon haMutal bi'Safek", when there are equal claims to the ownership of an object there are four posibile ways of deciding the law. In our Mishna, the law of "Yachloku" determines the Halacha. The Biblical source for "karov" is the parsha of Egla Arufa. In this shiur we will attempt to understand why Rov trumps Karov acc to Reby Chanina. Why is this Mishna dealing with the returning of a lost object placed here in this chapter of B"B which is dedicated to the laws of Harchakat Nezikin?
