Description

In the Sugya of Raksa, the damage that results from beating the flax in Bava Batra 26a, Ravina & Mar bar Rav Ashi argue about the opinion of Rebby Yossi & Girei Dilei. In this shiur we will study the unique approach of the Tos' Rid. Ravina agrees that Raksa constitues Aish, and that Eisho Mishum Chetyav, but nevertheless lacking Girei Dilei the Mazik is exempt because we expect the Nizak to protect himself. With Girei all changes and the Mazik is unconditionally responsible. But is Raksa Girei? Ravina says "no", but the evidence is stacked against him, from both Melechet Zorah and from Getz. Ravina deflects these attacks by introducing a new component to Girei, namely, Nicha Lei.
