Description

Is shor haniskal included under neveyla? After all, the shechita - after gemar din - is ineffective, leaving the animal a neveyla. Why does the Beraita need "U'Ba'al HaShor Naki" to derive the Issur Hana'ah of Shor HaNiskal, why not derive it from "Lo Ya'achel es bsaro"? In this shiur we will want to determine if this question is relevant even according to Chizkiya. The comment of Rav Eliyahu Mizrachi on Rashi in Parshat Mishpatim must be analyzed. We will look at the case of a Ben Pekua who killed a man. In this case the Heter Shechita is inherent in the animal itself, and the shechita "took place" before the animal became a shor haniskal.
