Description

Tos' in Psachim 25b assumes that because of Karka Olam a woman is permitted to submit herself to Giluy Arayot since she is passive. The same rule would apply to murder, namely, one does not have to give up his life rather than violating murder passively. Therefore in order to save one's life he can submit himself to being thrown onto a baby knowing full well that the weight of his body will kill the baby. The Rambam codifies the requirement of Yehareg VeAl Ya'avor and omits any qualification of Karka Olam. In this shiur we will analyze the machloket between Tos' & the Rambam and study the insights of Reb Chaim in his first essay on the Mishneh Torah of the Rambam.
