Description

In this shiur we will study the controversy regarding a stolen object, a lulav, succah or matzah, that is then used for a mitzva, when the Nigzal has already declared his Ye'ush. The object is now acquired by the Gazlan and in monetary law the status of the object as a Gazul has been rescinded. Is the object still Gazul as far as its status for Mitzvot is concerned? Does the Psul of Mitzvah HaBa'ah B'Avirah persist beyond Ye'ush when the Shem Gazul - as far as Dinei Mamonot is concerned - has been removed? We will see Rabenu Tam as quoted by Tos in Bava Kama, as well as his writings in the Sefer HaYashar. We will try to offer a new answer to Tos's question: why the need for the special Yalfuta of "Lecha" to disqualify a stolen Succah?
