Description

Once a beth din obligates a get, there are three different approaches regarding the propriety of a husband conditioning the giving of the get upon certain condition(s). One approach which is the majority opinion is that once a beth din obligates a get, the get must be given unconditionally. The second approach is that if there is a legitimate condition such as a wife who owes monies to her husband, a husband has a right to have the monies returned or have his claim adjudicated in beth din prior to giving the get . There is a third approach of Maharashdam who argues that a condition which is "easy to fulfill" can be advanced by a husband prior to the giving of a get.
