Description

In preparation for Pesach we will study Hilchos Pesach and address the question: may one throw his Chometz into the rubbish can on Erev Pesach? A Teshuva of Rav Moshe Feinstein in Igros Moshe will lead us to distinguish between two scenarios. If the garbage can is located on one's private property, the chometz has not left his domain & may require שריפה. This requirement does not seem to reflect the sugya of ביעור חמץ in Masechet Pesachim which establishes that there is no need for Bitul Chometz with regard to Chometz crumbs. The logic is that since one cares not for crumbs there is an automatic Hefkes based upon the rule of אנן סהדי. This should certainly apply to our case of chometz that one throws out. We will explain the difference.
