In this shiur we will compare and contrast two sugyos in Masechet Berachot: 11b & 21a, both address the nature of Birchat HaTorah. We will try to establish that each sugya defines a different element of the Beracha. The earlier sugya establishes the bracha as a matir; whereas the later sugya defines the Chovas ha'beracha. We will analyze the controversy between the Rambam & the Ramban re the latter, is the Chova DeOraisa or DeRabanan? We will investigate the apparent נפק"מ regarding Safek. This will depend upon the nature of Birchas HaMitzva in general, a debate between Tos' and the Rambam. Is it possible that even Tos' would admit that in one Mitzva, i.e. Torah study the beracha is essentially a Birchas HaMatir like נהנין לפי' ספק להחמיר
