We continue our analysis of Birchat HaTorah: how should we classify the Beracha, as a Birchat HaMitzva or as a Birchat HaShevach? On the one hand the Ri in Tos' drops the normal requirement of Birchat HaMitzvot that requires that the Beracha be immediately followed by the Mitzva act; yet, the Ri posits a contradiction between the law of Birchat HaTorah and the law of the Beracha over the Sukka, the latter is the paradigm of a Birchat HaMitzva. This contradiction makes no sense if Birchat HaTorah is a Birchat HaShevach! The sugya in Chulin establishes that speaking doesn't undermine a Birchat HaNehenin. Tos' vacillates with regard to Birchat HaMitzvot. Does a single Birchat HaTorah suffice for the entire day? It depends on the ספק of Tos'.
