Description

This shiur for Masechet Berachot 14b will study the mitzva of Tzitzis as the paradigm of a Mitzvas Aseh She'Hazman Grama. This would be simple if we assume Tzitzis Chovas Gavra, and the act of wearing the garment requires Yom. But if we postulate Tzitzis as a חובת טלית, then the mitzva of הטלת הציצית על הבגד is not limited to Yom to the excluding לילה. Tos' redefines Zman Garma. From the law of a כסות לילה פטורה we derive a new definition of זמן גרמא, namely, that it is the obligation of the mitzva not its implementation which determines זמן גרמא, and if the element of time plays a role in establishing the obligation then the mitzva is classified as זמן גרמא. In this shiur we will examine this new definition & see where the Rambam fits in.
