We will compare & contrast 2 sugyos in Chulin & Niddah. This shiur will serve as an overview of our introductory shiur, given this past Monday, to the definition of חזקה. The Ramban maintains that חזקה cannot operate if the שורש הספק undermines the חזקה. Therefore if we are certain that the מטמא came into contact with the foodstuff, the latter's חזקת טהרה is inapplicable. If we know that the ספק חלל had בעילה with this woman, her חזקת כשרות in irrelevant. According to the Ramban's principle we are perplexed by the sugya at the beginning of Niddah. If there is a ריעותא on the חזקת שלימה of the Mikveh because we find it today missing 40 Sa'ah, we then utilize the חזקת טומאה of the טובל. But why? His status depends upon that of the מקוה.
