Description

We will discuss the language of the mishna, the choice of the emphasis on the woman & the significance of the term קנין. Is this a kinyan similar to other Kinyanim or is it a unique concept called קנין איסור? Why the choice of דרך and is this a masculine or feminine word in Lashon Kodesh. Would there be a logical possibility that a woman can be married against her will? Why the Rabbinic language 'kidushin' rather than the Torah language 'kinyan'? Does the analogy between kidushin & הקדש have Halachik implications? We will introduce the controversy amongst the אחרונים re: the relationship between the קנין איסור and the קנין ממון. Which comes first? In this light we can touch upon and glimpse at the concepts of מיתת הבעל and זיקת יבום.
