Description

For the sugyos in Bava Kamma 10a-b we will spend significant time on comparing the חומרות וקולות of the various Mazikim. Our attention is turned to Keren, Bor, and Aish, each of these has unique regulations as compared to the other. The latter part of our shiur today will focus on various scenarios in which there were two participants in setting up a Hezek: is the last one obligated to compensate the damaged? For example, the first one dug part of the Bor but the 2nd completed the Bor and dug an additional Tefach. Or the force of the last one was responsible for the extra weight that caused the breakage of the couch or the death of the victim. It is clear that if the action of the 1st could not cause the damage, the 2nd will pay.
