Description
For Masechet Ketuvot 9b we wish to address the question: with what claim is the husband believed to undermine her claim to the Ketuva? Is it enough that he claims "I found her to be a בעולה"? Or must it be a claim supported by witnesses, i.e. a טענת דמים? He should be believed with any claim since he is in possession of the monies of the Ketuva. But she has a number of possible counter claims to support her rights to the Ketuva. If he has no evidence we could question his own capability of determining that she is a בעולה. Another possibility is that she was raped. We will suggest that it depends upon the source for ketuva. If Rabbinic, the Rabbis rely on his claim because of the $ and effort he put into this marriage.
