Description

The sugya in Masechet Bava Kamma 51a introduces the Bor that belongs to two people & who pays damages? Bot 'partners' were negligent but the 1st to use the Bor passed on the use of the Bor to the 2nd partner, and ultimately the responsibility falls on the shoulders of the 2nd. How do two people own a Br jointly? If a privately owned Bor is liable then we understand. But if the Bor of the Torah is n the public domain how do we have joint ownership? The sugya will ffer various possible scenarios. We will study the debate between Rebby & the Chachamim regarding a Bor taht was dug nine Tefachim by Reuvain & Shimon dug the 10th Tefach, who is liable if an animal is injured in this Bor? If the ox died in the Bor only Shimon would be liable.
