Description

This shiur for Bava Kamma, 62b-63a offers an Introduction to the 7th Chapter of the Masechet, Perek Hachovel. We will study the basic concepts that apply to the Ganav (thief): Keren, Kefel,and Daled Ve'heh. The opening word in the Perek can be understood in two ways with a crucial difference. What if anything can we prove from our Mishna regarding the Shomer Chinam who takes the oath to the effect that the object was stolen and then is proven to have stolen the object himself! Surely he pays Kefel; but what if he sold or slaughtered the animal, does he pay 4x and 5x? Did the Shomer take the oath before or after the sale? If an object was stolen from a thief is the 2nd thief the Shomer considered a thief such that he will pay for אונסין?
