Does Lashon Harah & motzi shem ra apply vis-a-vis the dead? In this Halacha shiur we will assume that these violations are typical of the class of Mitzvot Bein Adam LaChaveiro as negative speech distresses the victim of that speech. But are the dead aware of the going on's of this world? Is a deceased insulted by slander against him? We will study the Aggadeta in Masechet Berachot which addresses this question. Although there is no definite conclusion in the sugya, the Mordechai quotes the earlier authorities who established a חרם against those who slander the dead. The requirements to repent and rectify the violation of this חרם are demanding. The position of the Mordechai is brought down in the Codes. Is Lashon HaRa included in the חרם?
