Description

The sugya in Masechet Bava Metzia 3a-b adds more analysis regarding reconciling our Mishna of Talis with the views of various Tanaim who insist on deciding cases of Safek Mamon in alternative ways. These Tanaim apparently reject the ruling of divide the Talis and impose the oath. But rather prefer other rulings, e.g. יהא מונח. The last half of the shiur is dedicated to introducing the Kal VaChomer of Rebby Chiya to establish that the oath in our Mishna is a DeOraisa oath of מודה במקצת.
