Description

We will complete Masechet Bava Matzia 25b and begin B"M 26a with a study of the first part of the Mishna of כותל ישן וגל של אבנים. Why does the finder keep for himself what he finds hidden in the old wall? Did he find an object without a סימן? Do we assume that the object was once owned by an Emorite from before the period of the conquest of the Land? How does the finder counter the claim of the Jew who owns the wall? Can the latter acquire the lost object with קנין חצר? In the case of a newer wall can the original owner claim that he deliberately concealed his possession in the hole of the wall? Can we say the owner left it there for so long that he despaired of even getting it back? Or perhaps hiding is not hiding & it's אבידה מדעת?
