For Masechet Bava Matzia 41a-b we will study the Mishna which divides into two parts both of which address the issue of the Shomer who was שולח יד בפקדון. Some interpret the Mishna as referring to a גזלן, others a שואל שלא מדעת. The main issue is: does the Shomer become responsible even for circumstances beyond his control (אונס) after the moment of 'replacing' the object, i.e. הנחת החפץ. Does השבה require דעת בעלים? Can we reconcile the beginning of the Mishna with the end?
