Description

For Masechet Bava Kamma 106a-b we will study two sugyos. One, the view of Rav, namely, the Shomer acquires the cow if he took a false oath. When does this apply? We will see that the Shomer claimed 'the cow was lost' & then he took a false oath, then the witnesses came to testify that the Shomer is holding on to the cow. If the shomer was מודה then he does not acquire the cow. The following sugya deals with the unique category of גניבה that applies to a Shomer who claimed the cow was stolen & then took a false oath. Would the Shomer pay ד' וה' if he slaughtered or sold the cow?
