Description

For Masechet Bava Basra 69b-70b we will study the sugya of sales & exclusionary clauses, fields and trees. He sold a field but not its trees, yet he added an exclusionary clause in which he excluded a particular tree or half a tree from the sale. Did he mean to include all other trees in the sale? The second half of the sugya deals with a claim against orphans and an object that was deposited in the hands of a Shomer. The מפקיד is holding on to a Shtar, yet the Shomer claims he returned the object and should be believed with a Migo - he could have claimed אונס.
