Description

For Masechet Bava Kamma 112a the sugya addresses the issue of accepting testimony against a קטן, when can such testimony be valid? Is this identical with עדות שלא בפני בעל דין? Here in the case of קטן there is no בעל דין to be had; in the cases of a גדול we have a בעל דין but there is a technical barrier which prevents the בעל דבר from being there at the moment of testimony. We will discuss the case of a קטן who locked the plaintiff out of the house or confiscated the property of the plaintiff.
