1. The Maharshal says in the Chochmat Shlomo that the bat cohen was burned at the stake as a הוראת שעה. Rabba, in fact, imposed the death penalty (Shabbat 156a). 2. Rav Moshe, in a letter to then NY Gov. Hugh Carey supported the death penalty for people who are cruel and do not care about the prohibition or if murder is rampant. It would seem that his reason (מלך עושה משפט) would also apply to the Israeli government.

Actually Israeli military courts already have the power to impose the death penalty but it must be by a unanimous vote of the judges. The bill would have allowed it if only one so voted.
