Description
Menachot 2a-b: Reconciling Rebby Shimon with the first Mishna of שלא לשמה in Menachot. Our Mishna assumes that the בעלים would have to replace the Mincha whereas R' Shimon in the Beraisa opines that the Mincha is not only כשירה, but it is even עולה לבעלים לשם חובה. The latter is based upon a fundamental distinction between Menachot & Zevachim. The former is subject to the principle of מעשיה מוכיחין עליה, a principle that cannot be applied to Zevachim. However, the sugya establishes that in at least one case we can apply מוכיחין to a Zevach, namely, the case of a חטאת העוף that was נמלק לשם עולת העוף. The fact that the דם was applied to the lower half of the Mizbe'ach clearly indicates that this is not an עולת העוף which requires למעלה.
