For Masechet Bava Kamma 106b we seek to analyze the view of R' Yochanan re: טוען טענת גנב בפקדון. R' Yochanan establishes that if the Shomer slaughtered the cow he must pay ד וה. Why didn't the Beraisa discuss a case where the Shomer slaughtered a Tereifa or a cow that was stolen by partners or the שחיטה was implemented subsequent to the final verdict of Beis Din? In all these cases there is a חידוש as to why the Shomer does not pay ד וה for the שחיטה.
