Description

The sugya in Masechet Bava Kamma 108b addresses the issue: who is the בעל דין to sue the thief, is it the owner (מפקיד) or the Shomer? This will determine the status of the confession of the thief. If the thief confesses to the Shomer, does that exempt the thief from the penalty of כפל? Such exemption only applies if the thief confessed to the בעל דין. At the end of this aspect of the sugya, the Gemorah addresses the question: Is the Shomer required to track down the thief?
