For our study of the laws of תליה in cases of doubt, we will analyze 2 sugyot, Masechet Pesachim 10a & Massechet Niddah 58b. There is a great similarity between the various scenarios of תליה: two houses that were already checked & a piece of Chametz went into 1 of the houses, 2 Kosher pots & a piece of non-kosher meat fell into 1, 2 roads & a body was buried in 1, 2 ladies saw כתמים & handled a bird. The Poskim work hard to find consistency in the laws that govern these cases. The basic rule is established by the sugya in Pesachim called שני שבילין: if the two people who are בספק came together to ask about their status they both are טמאים; if they come separately they are both טהורים. The Rashba refuses to apply these rules to the 2 pots.
