Description

For Masechet Bava Kamma 6a-b we will study the 4 approaches to הצד השוה; each of the four Amoraim presents a scenario which cannot fit into one particular Av Nezikin, but rather requires a combination of two Avos. We will discuss the Rosh who insists that all four cases are בור. Another view maintains that the specific exemptions of both Avos, e.g. of Bor & Shor, will apply in the Tzad HaShaveh. The last segment of today's shiur will serve as an introduction to the sugya of מיטב, the great debate between Rebby Yishmael & Rebby Akiva. Is the damage evaluated based on the מיטב of the damager or of the victim. How does R' Yishmael reconcile the verse with his Gezeira Shavah?
