Description
For Bava Kamma 46a-b we will address the issue of splitting the Muad into two parts, part Tam & part muad. This may apply to every Muad acc to R' Yehuda since the Tam part requires the highest level of Shemira, the Muad part only the lower level of Shemira. Beyond this is the case of an ox that consistently gores from one side of its head. We complete the 4th Perek with a discussion of the view of R' Eliezer that a Muad should be slaughtered. We begin the 5th Perek with a Mishna & sugya regarding ממון המוטל בספק & the great debate between Sumchus & the Rabanan, and an auxiliary debate between Rav & Shmuel if one sold an ox & it can only be good for its meat, do we rely on רוב and cancel the sale? Shumuel is a staunch advocate of חזקת ממון.
