We know that the thief acquires the stolen object thru שינוי, e.g. if he stole wood & made a utencil. Our sugya in Masechet Bava Kamma 66a-b presents the great controversy between Rav & Rabba regarding whether the thief acquires the stolen object by virtue of ייאוש, i.e. if the victim of the theft despairs of retrieving his stolen object. Do we accept the analogy to a lost object where Ye'ush operates? Or did the Chachamim institute the validity of Ye'ush in גזילה, and if so why and under what circumstances?
