We begin the sugya in Bava Kamma 81a of the ten conditions Yehoshua ben Nun established for Bnei Yisrael entering and inheriting the Land of Israel. Anyone in need of grass, wood, or shoots of trees, is permitted to enter into the forests or fields of others in order to obtain these items. The owner of private property would not have the right to object and block his fellow Jew from entering his land and taking the grass, shoots, etc. Even in the case of a spring of water, permission was granted to access the water of a privately owned spring. This would guarantee ample water supply for all. We will learn about limitations in these Heterim to protect the owner from financial loss. Is Yehoshua based on mutual consent? Or upon הפקר ב"ד?
