For Masechet Bava Matzia 48a-b we continue our study of the debate re: קנין מעות מן התורה, does the Torah recognize & validate the קנין when the buyer paid the money. Rava seeks to prove the view of Reish Lakish that the Torah requires a משיכה in order to clinch the קנין from both the verses in the Torah and from a Beraisa as well. The latter half of today's sugya will address the legal status of a down payment, can it clinch the Kinyan on the entire commodity or only for a portion that corresponds to the value of the down payment? We will discuss the concept of a מי שפרע when one backs out of a transaction after he had committed himself to follow thru.
