Masechet Ketuvot 34b: When does the שואל incur his חיוב תשלומין? Three possibilities : the moment of משיכה, or the moment the Sho'el was פושע, or the moment the object was destroyed? The second half of today's shiur is dedicated to the debate regarding the application of the principle of קילבדר"מ - is it limited to the עונש בפועל or does it extend to include any violation of an עבירה המחייבת even if there will be no punishment for the violation, e.g. there was no התראה. On this issue we will study a Machlokes between R' Yochanan & Reish Lakish.
