The sugya in Masechet Bava Kamma 23a-b offers a further analysis of אשו משום חציו, the opinion of R' Yochanan. Why should אש be exempt from payment for utensils that were concealed by the haystack and went up in smoke? We never found exemptions in אדם המזיק. In fact the latter is liable even for אונס as derived from a verse in the Torah. The sugya establishes that even R' Yochanan adopts the position of אשו משום ממונו in the case where the fence that contains the Aish fell down, i.e. כלו לו חציו. We will study the case of the dog that dug its way under the fence and ate the cookie. One who sends someone's dog or snake to injure the victim who is responsible? In who's Reshus is the food in the mouth of the cow?
